Police: Fast food employee calls police after smelling alcohol from patrons in drive-thru

HEBER CITY, Utah (ABC4 News) – Three people were arrested after an employee at a fast food chain in Heber City smelled alcohol coming from their car and called police. 

According to arresting documents, the suspected DUI driver’s car was located after dispatchers put out an “attempt to locate” for a blue SUV he was driving. 

The officer stopped the vehicle and identified the driver as 48-year-old Santiago Ramos who gave the officer consent to search the vehicle.

The officer found drug paraphernalia under the front passenger seat where his passenger, Kim Cuch, 49, has been sitting, documents state. 

Documents further state Ramos also does not have a valid Utah driver license and when he was searched, officers found a pipe and methamphetamine. Ramos admitted to police that he had smoked meth within the last few hours.

In a further search of the vehicle, officers located two sets of bolt cutters, a “slim-jim” device that is commonly used to break into vehicles, and a homemade siphoning pump, according to documents.  

A rear passenger, Diana Gustamantes, 51, was also searched and officers found aluminum foil in her pocket and a small straw called a “tooter.” On the foil was a dark brown substance that later tested positive for heroin, documents stated.

Ramos is facing misdemeanor charges of possession of a controlled substance, possession of drug paraphernalia, driving with a measurable amount of controlled substance, driving without a license, possession of burglary tools and failure to signal. 

Ramos was previously arrested in February in Salt Lake City for allegedly stealing a car and possession of drug paraphernalia.

After a record check of Cuch, officers found an active warrant for his arrest out of Heber City. While at the jail, officers found five small baggies of marijuana inside his shoe.

Cuch is a convicted felon and a registered sex offender. He was convicted of aggravated sexual abuse of a child in 2003 and was released in 2013. Since then, he has faced additional charges of disorderly conduct, assault and drug abuse that has put him back in prison for a short time in 2016.

Cuch is now facing misdemeanor charges of possession of drug paraphernalia and possession of a controlled substance within a correctional facility. 

Gustamantes is facing misdemeanor charges of possession of a controlled substance and possession of drug paraphernalia. She has a criminal history that included charges of theft, drug possession and criminal mischief.
