Murder suspect mistakenly released from jail

WEBER COUNTY (News4Utah) – A murder suspect arrested in Ogden in August and ordered to be held without bail was released from jail apparently by mistake.

Cory Fitzwater was booked into the Weber County Jail in connection with the death of 28-year-old Brian Racine.

The Standard-Examiner reported, due to a miscommunication error, he was able to post $20,000 bail and was released before the no-bail order was signed by the judge.

Once the error came to light, Fitzwater actually turned himself in on Monday and he’s now back in jail, to be held without bail.
