SALT LAKE CITY, Utah (ABC4 Utah)- A key piece of evidence was tossed out in the rape case against a former Brighton High and USC football.
Osa Masina is facing charges of rape and forcible sodomy. Thursday morning lawyers from both sides argued about whether an alleged Snapchat video of Masina with the victim should be a part of the case. The judge decided the video and any testimony related to it will not be admissible during the trial.
The state wanted to mention the Snapchat video and testimony from the witness of the video.
“I think the judge said it very clearly. There’s not a very good foundation for this evidence. It’s not clear it even existed and Number two, [the witness’s] testimony was all over the place. He doesn’t have any rational basis to claim the video was non-consensual sex ,” Defense Attorney Rebecca Skordas said.
