Gang member arrested for raping teen, threatening her if she told anyone

SALT LAKE CITY, Utah (ABC4 News) – A 27-year-old documented gang member was arrested after an investigation into a rape reported back in February of 2018 by a young teen. 

According to charging documents, a 14-year-old girl told police her and a friend were picked up at a convenience store near her school by a man named Daniel Silva. The teen said Silva provided them with alcohol and marijuana. 

The teen said she got too intoxicated and did not realize Silva had dropped her friend off elsewhere and taken her to his home in Salt Lake City.

The teen said she recalled going upstairs with Silva and he put his hands around her waist. When he put his hands between her legs, she pushed him away and said she was not comfortable. Silva told the girl he did not care and forced himself on her,  according to the statement. 

The teen said she vaguely remembers all that happened but she woke up to him “cleaning her up” When the girl woke up, she was in a lot of pain. She said he then raped her again. 

The teen said she told Silva to stop multiple times, but he would not. 

After the alleged rape, Silva took her to buy new clothes because she had vomited on hers the night before. 

When Silva dropped her off at the mall the next day, the teen said he had a gun in his lap and told her not to tell anyone his name. 

Silva was already incarcerated for other crimes at the time of the filling Monday. Silva is listed as a documented gang member with law enforcement.

He is charged with first-degree rape and forcible sodomy, second-degree obstruction of justice and misdemeanor contributing to the delinquency of a minor. His bail was set at $500,000.
