SALT LAKE CITY (AP) - The Utah attorney general's office has refiled a case against a retired Air Force major whose federal case was dismissed in May after his defense attorney argued that the stress of the case could kill him.
The U.S. attorney's office had charged Reinaldo Canton for allegedly arranging to meet an underage girl for sex in Layton.
Canton, 45, agreed to a plea bargain. But he suffers from a life-threatening heart condition and his defense attorney argued that continuing the case could increase Canton's blood pressure and kill him, violating his right to due process.
In May prosecutors asked a U.S. District judge to dismiss the case.
On Tuesday, the Utah attorney general's office filed a $10,000 warrant for Canton's arrest and three class A misdemeanor charges of enticing a minor over the Internet.
