Working to Fix Worker's Compensation

SALT LAKE CITY (ABC 4 News) – An ABC 4 investigation uncovers questionable practices when it comes to the Utah Labor Commission and its Administrative Law Judges. Some even say the ALJ has robbed them of their families and livelihood. Dennis Owen is one of them. “I'm in the middle of moving because I can't afford this home,” said Dennis.

Don't feel lonely I have had 6 surgery's in the last year and the 4 Doctors that did them at the University Hospital in Salt Lake City have ordered pain Management and told Workmans Comp that I would never be able to work again and Workmans Comp has refused to pay for the Doctors ordered pain management and are now trying to force me to go back out and find a job when doctors refuse to release me to go to work. All it boils down to is they think the money come out of there own bank and they get paid to close a case and don't care about the one hurt or there family. We should all stand up as one and fight for what is right cause it was not are fault we have to work a true days work to feed are wife and kids and get hurt. If it was them they would lay and cry cause there own people would not care for them eather. But I wont lay down cause there doctor is the one that messed me up and I ask for the university but was told I could not go there I had to go to there doctor that could not tie his shoe. But in the end they have so many on the pay roll that are scaired of them But I am not one of them I now have life long damage and the want to run and hide well they cant run far cause the courts have the last say and they have made me lose the use of one leg and now I depend on a cane to walk. Please don't give up and stand strong for you self and your family.................................................

I was also denied Workman's Compensation due to Carpal and Cubital Tunnel surgeries. The most interesting thing about this was that when I did some more research, an fellow co-worker had the exact same problems and surgeries a year earlier and her claim was approved and paid in full. When I mentioned this in my arbitration hearing, the 1st thing that they suggested was that it was probably a different insurance company. When they checked that they found that it was the same insurance agency that approved her surgery and denied my claim. All of a sudden they were anxious to settle.

LThe entire industrial workers compensation is not only broken, but corrupt. I worked as a nurse case manager and witnessed, first hand, how unlawful and unethical the system"trashes" human beings (workers). The problem is far reaching - from a state government (legislators and governor) who are probusiness and desirethe to keep theyour cost of doing low i.e. insurance rates and highly restricting benefits and damage awards to insurance carries and a small group of physicians whose most if not all of their income is paid by insurance carriers to perform "independent" medical examinations. It is interesting most if not all "adjusters" do not have any formal education in healthcare, yet make financial decisions bases upon the information they choose to believe and interpret. Why aren't more attorneys available to help claimants, because fees are capped. The problems and corruption just goes on and on.

wallytoyou........actually your right, I should have said that about the insurance company, I edited my comment and took out the name of the insurance company and my comment did not make total sense. But that is where my agreement with you stops. The judges have total responsibility for payment, because without their stamp of approval, no money funds. And as far as Commissioner Hayashi is concerned, she was brought in to clean up the mess, and she has done nothing but allow it to continue. Actually each time I went to a hearing the ruling was in my favor, but the next day the games started again, the fake doctors appointments scheduled, the cancellation of treatments and prescriptions. And... another hearing would be scheduled, which takes six months, and then a year for a decision. If you think that the system is working, you are clueless, or you are part of it. And not everyone is an English wizard, but your condescending comments are really of no help.

This report was a mishmash of 3 different stories, with no clear idea established. This report wouldn't have passed if it was a project for a high school journalism, english, or government class. For the comments to call some one ignorant maybe you should one, get the persons user name correct it is wallytoyou, not wallytootoo. Practice some proper grammar. Get these supposed facts you speak about and present them, or site somewhere I can find them inyourface. Wallytoyou has presented where you can find something solid that backs up what she is stating you have not. Inyourface, you have also abandoned all logic for adolescent name calling. I have to admit that you have me, inyourface. I have no idea how to respond to someone whose main retort is name calling and misspellings. Amazing. There is no amount of reason that would cause you to stop, listen and look at real facts. I am afraid that I can't trust you, even though you ask me to. There is in fact Concrete evidence proving the Judicial Bias and prejudice as well as bias on the part of their so-called independent or impartial medical examiners.Why do you think the Legislature is involved.This has nothing to do with my being angry that I did'nt get a favorable decision I liked.You Moron! The issues with the insurance companies have already been addressed with the Auditor Generals Office. Based on the evidence we have the insurance companies, the employers and the Labor Commission are all colluding with each other.Keep telling your self these lies, idiot. So,since you claim to have all of this experience with the Labor commission perhaps you should enlighten us all as to your special prowess in that area.Or is this more of your rediculously ignorant attempts to dazzle us with your diluted brilliance or baffle us with your bloated bovine intelligence.It is plain and clear here that you just can't fix your case of stupid.You have an obvious bias in favor of the labor commission and no evidence or facts or anything else will convince you otherwise.Trust me when I tell you this. Interestingly enough, I have a lot of experience concerning the Labor Commission. The judges have no agenda, they are required to base their rulings on the facts presented. I really think your anger would be better spent addressing the insurance companies, who are the ones who are refusing to pay. The Labor Commission has nothing to do with helping you get better, that concerns what the insurance company is willing to pay and what they are ordered to pay. Commissioner Hayashi should spend more time backing her employees than believing every "bad" thing that she hears. There are no "CONCRETE FACTS" concerning crooked judges and no fraud because that has not happened. You may be angry because you did not get a ruling that you agreed with, but you should take that up with your attorney, they are the ones who represented you and lost the case.

wallytoyou..........you apparently, have no experience with the Labor Commission and/or being an injured worker. It is one of the most dishonest systems in the country, and totally against the injured worker. They will spend $10,000 to not pay $1000.00. They have no interest in getting you better, they just want you to go away. I cannot go into details here for multiple reasons, but lets just say I have a decade + of experience with the "system"
