Man accused of accidentally firing bullet into neighbor's home

I live in VA and I had a neighbor fire a bullet in my kitchen. The kids were upstairs and I was downstairs (luckily). The judge said he was guilty at the first hearing, but the final disposition of the case was dismissed. I don't want to ruin the kid's life, but there has got to be some sort of action. Drunk drivers that don't cause accidents can get jail time, but if you shoot a bullet in your neighbor's house the charge get dismissed? It seems odd to me. I still find it unbelievable that anyone can buy a gun without any training at all.
