SALT LAKE CITY (ABC 4 News) – Kevin Garn, House Majority Leader took the final moments of the 2010 legislative session to announce he paid a woman $150,000 to keep silent over a nude hot tubbing incident with her when she was just 15.

In a statement on the House floor, 55-year-old lawmaker Kevin Garn from Layton stood before his constituents and said during an unsuccessful 2002 bid for Congress, he paid the woman to keep quiet.

“Representatives, 25 years ago, I made a mistake that has come back to haunt me. I was 28-years-old and I foolishly went hot-tubbing with a young woman nearly half my age. Although no sexual contact happened, it was clearly inappropriate and it was all my fault,” Garn said.

After Garn read his prepared speech, House Speaker Dave Clark became emotional and complimented the majority leader's service. The representatives then gave Garn a standing ovation.

Cheryl Maher later claimed to be the victim, and reportedly told other media outlets that more happened than just skinny dipping in the hot tub.

Maher claimed she contacted reporters and representatives to share her story. She said the hot tub encounter with Garn happened in 1985 when she was 15.

Since then, Maher said she's struggled over the years with pills, alcohol and mental health issues.

Garn’s wife was by his side during the announcement. He said he told his family about the incident years ago, and that they have forgiven him.

"Twenty five years ago I made a mistake that has now come back to haunt me. I was 28-yrs old and I foolishly went hot-tubbing with a young woman nearly half my age. Although we did not have any sexual contact, it was still clearly inappropriate -- and it was my fault.

 

One of the consequences of that decision was the negative impact it had on this young person’s life. Years later, when I was running for Congress, she decided to bring this incident to the attention of the media. Shortly thereafter, my wife and I met with her, and at her demand, I paid her $150,000. While this payment felt like extortion, I also felt like I should take her word that the money would help her heal. She agreed to keep this 25-year-old incident confidential. Now that this issue is coming up again, it is apparent to me that this payment was also a mistake.

Today, she went to the press and reported all of these events. There will be a story. I expect to suffer public humiliation and embarrassment, but I also want you to know that I cannot allow one foolish mistake to continue to shadow my life. At this point, I would rather be open and honest about this than continue to live in fear. Some lessons are hard to learn. This is something I should have done back in 2002. But I was scared. I did not want to be publicly judged by one of my life’s worst decisions.

 

I told my wife about this incident years ago, as well as my children. I may not deserve their forgiveness, but they have given it. My primary concern at this point is that my wife and the rest of my family know how much I love them. I am sorry for this incident. And I am sorry I ever responded to the financial demands.

 

I also wish to publicly apologize to this young lady for this incident. And I apologize to you, my colleagues, for any shame this brings to the Utah State Legislature. I have tried my best to serve my constituents in a way that brings honor to them and makes this great State better than the way I found it. I hope to continue to do that.

The act of hot tubbing nude with a 15 year old is certainly wrong. I'm sure he's struggled with this memory for longer than he would have been jailed for it. I personally think he has suffered enough and should be left alone to a clear conscience now that he has made it public. If we cannot recognize the personal torment Garn has already suffered AND forgive him, we don't deserve to be forgave for the bad things we do in our lives either...ever!! As for the woman, sure I feel bad for her. I also feel bad for her family. I would have been beside myself if I had been her parent and understood this situation before she resorted to extortion. However, her actions are NOT worthy of any praise or sympathy either. He was bad at the time of the occurance...he has surely suffered. She is the pathetic one who is trying to capitalize on his position today.

Just because he admitted to doing what he did, why should he be praised for admitting it? I say that he should have had better sense that to do it in the first place and I certainly don't think that just because of the fact that he admitted to it, he should be put back into the position that he held. Why did he pay the girl not to talk about it and then fess up.

I don't think he deserves a standing ovation. That actually hurt his chances! But to me it is obvious that the "girl," now a woman is just looking for money. It happens all the time, and after 25 years, should be forgotten. After all, she was paid well for her pain and suffering once. Once is enough.

Davis County may go after the victim for extortion? A misguided 15 year old girl is seduced by a 28 year old man in 1985. She approaches him in 2002 for money which he gives her, hopefully out of the goodness of his heart, for therapy. He then tells his family at some point probably shortly before going public so he can get out of giving her money again and is forgiven completely. I'm all for forgiveness of all people but a price is generally required for this behavior. He doesn't have to go to jail but losing his elected office is required. He should step down from Government and show us how contrite he is over this error in judgment.

A standing ovation? Are you kidding? That is the extent of the morals of our legislators? Keep a secret for 25 years and when you finally maturate to the point you're feeling guilty, you confess after paying her off. This is one of our trusted civic leaders? He has lived this lie for 25 years! His wife should dump him and take every penny he has. And our trusted state leaders see him as courageous. Everyone of the legislators that applauded obviously have the same morals. No wonder we don't trust our political leaders!

I thought it was inappropriate for the legislature to give Kevin Garn a standing ovation. How naive are they? He was in a hot tub with a 15 year old, but nothing happened. Ya, right, the $150,000 was just a gift not hush money. I can't believe all the school teachers being thrown in jail for fooling around with children, and he gets applause.

I am sickened by the seemingly double standard that is held in this state!!! They got rid of the guy who drove drunk, and give this moron a standing ovation???? Vote them ALL out!! This is disgusting and I agree with Richard!! A pure SLAP IN THE FACE!!!!

It was bad enough what Garn did, but to have the GOP give him a standing ovation was wrong and showed poor taste and is a slap in the face to the people of Utah

Am I the only one that finds it extremely fishy that this woman said she needed 150K to heal in the first place? If all they did was get in the hot tub together, why would she need to heal over that? I'd be willing to bet he had sex with her at the very least and, perhaps, even raped her. Disgusting when this state is filled with the same people (members of the Mormon Church) who donated over $20 million to prop 8 which bans gay marriage in the state of California - not even their own state. As others have said, what is wrong with this picture? And yet we applaud someone "brave" enough to come out with a half-truth 25 years later. This country is filled with this mentality... we're so awesome, aren't we.

Attention Federal Lawmakers: From laws passed that send 15 yr old girls to prison for paying $150 for abortion attempts and a failure to provide sexual education other than abstinence only garbage, we move onto the leader of the same lawmaking body paying $150,000 to keep a 15 yr old girl silent, coupled with Church owned media outlets not keeping the public informed and spending monies to create laws inline with church hypocrisy in this state and others. It is my forced opinion based on facts and allegations that, Federal Investigations of Church interference in the legal system through lawmaking bodies in this state and others deserves the strongest consideration.
