SALT LAKE (ABC 4 News) - Despite an order from the state's Records Committee, Utah's Department
of Public Safety is refusing to release the DUI arrest record and video of former Senate Majority Leader Sheldon Killpack.
Not once.
Not twice.
But now for a third time, in a letter to ABC 4, DPS says Utahns can't see records which have already been ruled public.
The notice from the Attorney General's office is short but not sweet:
"...DPS intends to petition for judicial review by the district court ...the Records Committee's Decision."
Translation: the DPS Commissioner is now appealing a direct order to release Sheldon Killpack's DUI arrest record and video.
On February 11th, the Records Committee made clear Killpack's DUI records are public information.
But almost immediately, there were signs DPS might again block the public's access.
Since Killpack's January 15th arrest - 7 weeks ago - ABC 4 has been arguing for the release of his 4 page DUI arrest record and his 3 hour dash cam video.
But now, for a third time, DPS is saying the public will just have to wait, even though Utah's Records Committee says it doesn't.
ABC 4 has already been in contact with our attorney since receiving DPS’ notice of appeal.
The station will continue to seek these DUI records on the public's behalf.
This despite being rebuffed three times by the state agency which has been ordered to release them.
