The costs of a lawsuit are generally paid by each party unless specified differently in a state statute or a contract between the parties. Costs of maintaining or defending a lawsuit include not only attorney fees, but also expenses such as filing fees, facsimile and telephone charges, and deposition and expert witness costs. These expenses are generally to be paid by the client as the expenses are incurred. However, under a contingency fee agreement, the attorney may agree to advance certain expenses with the understanding that the client will reimburse the advancements regardless of the success of the claim.
