Utah legislative bill aims to stop gender selective abortions

SALT LAKE CITY (ABC 4 News) – It's a bill aimed at stopping Utah women from getting abortions just because they don't like the gender of their baby.

And ABC 4 News has learned this bill is now being written by legislative staff
on Utah's Capitol Hill.

On a public list of possible bills for next year's legislative session, one of the bills is called,

"Gender Selection Abortion Prohibition."

The bill’s sponsor, Republican State Senator Margaret Dayton, tells ABC 4 she now has a rough draft of this new abortion bill.

She's also getting input from other state lawmakers and the bill may get debated at January's legislative session.

In a phone conversation Tuesday, Senator Dayton said,

"I think it's a concern. I think there is a need to protect the unborn."

Dayton says gender-selection abortion bills like hers have already been passed in several other states and suggests Utah now might need to take a look at it as well.

But Dayton isn’t just looking at gender; her bill might also try to prevent abortions based on the baby's race.

She told us,

"I feel like it would be very concerning if abortion were performed specifically for the purpose of race. For someone saying I am not interested in having a child the same race as the man that impregnated me."

A similar federal bill was defeated by the U.S. Congress earlier this year.

This bill would, reportedly, have imposed fines and prison terms on doctors performing “gender selective” abortions.

But Senator Dayton told ABC 4 she wants a "reasonable" way to enforce her bill.

If the good Senator from Orem *really* wants to eliminate gender selective abortions perhaps she should sponsor a bill that makes it illegal to find out the sex of the unborn infant. After all if our creator really wanted us to know the gender before birth s/he would have made it so long before the evils of science made it possible.

These proposed Utah laws to stop abortion based on the fetus's gender or race are just more dishonest administrative obstacles to a woman getting an abortion. These laws will certainly be written to give the woman the burden to prove the wanted abortion is not based on gender or race. And, of course, a woman will almost never be able to disprove a legal presumption that she wants the abortion for race or gender reasons. There's no way this rabidly anti-abortion Mormon Utah legislature is going to go along with just the woman's affidavit saying it isn't for race or gender reasons. The authors and supporters of these bills are just trying to place more onerous obstacles to exercising what is still a Constitutional right. It's like Republicans enacting laws to prevent in-person voter fraud when there is no significant problem with in-person voter fraud -- solely in order to suppress the Democratic vote. Republicans here want to enact these anti-abortion laws when there is no evidence of any significant problem of women having abortions because of the gender or race of the fetus; they just want to prevent all abortions even though there's technically still a right for a woman to have an abortion.
