OGDEN, Utah (AP) - The Roy High School student charged in a plot to blow up his school is set to appear in Ogden's 2nd District Court.
The Thursday afternoon hearing was set for Dallin Morgan's lawyers to tell a judge whether they want an evidence hearing.
A preliminary hearing would be held at a later date if defense lawyers ask prosecutors to show their evidence and Judge Michael Lyon to decide whether a trial is warranted. Defendants can waive preliminary hearings.
Morgan was charged along with a 16-year-old boy in January with possession of a weapon of mass destruction. Police recovered no bomb, but conspiracy is an element of the charge. The students' classmates tipped school authorities to a plot to bomb a school assembly.
