Are controversial claims real against Lone Peak’s football coach?

HIGHLAND, Utah (ABC 4 News) – The former football coach at Lone Peak High School is facing some controversial claims. But did the coach really break the law? ABC 4’s Brian Carlson investigates.

Former Football Coach Tony McGeary at Lone Peak High School is in the middle of a financial scandal.

"I was shocked, I was like is this really happening?" said Sawyer Mullane, Sophomore player #20.

His players couldn't believe it. Monday the championship coach quit after a 42 page complaint emerged claiming McGeary illegally profited from the team. The documents show McGeary overcharged players for a training camp at Utah State University Eastern, formerly known as College of Eastern Utah, and pocketed $5,735.

But did McGeary really violate the law?

Thursday Reporter Brian Carlson called USU Eastern to find out. Carlson was told at least 4-6 high schools regularly hold camps at USU Eastern, including East High School and Bingham High. A spokesperson said McGeary isn't the only one who overcharges his players.

"They have an amount of money that's charged for the camp itself, but then there are other charges that are associated with the camp. The one that comes to mind most quickly is they all have to pay transportation. So they have to charge a bus fee on top of that," said Brad King, Vice Chancellor, USU Eastern.

But that doesn't mean McGeary is off the hook. Carlson talked to an attorney with the Utah State Office of Education. She said it doesn't matter how many other coaches did it. She opened up the Utah State Code and explained if McGeary used his job as a coach to advertise the camp and then pocketed money from players, he broke the law.

"The coach is essentially paid based on how may students he recruits. And I don't think that's very complicated to work through," said Carol Lear, Attorney, Utah State Office of Education.

In McGeary’s resignation letter he said he didn't do anything wrong.

"I believe I have handled every aspect regarding finances for our program with the utmost integrity and character," said McGeary.

So maybe McGeary didn't know any better. But when Carlson asked the Alpine School District if the coach knew the rules, they say he did.

"Was coach McGeary trained and educated on what the policies were?” Carlson asked.

“Yes. Yes he was, as were all the coaches in the district and athletic directors," said Rhonda Bromley, Alpine School District Spokesperson.

The 42 page complaint suggests McGeary committed a 2nd degree felony by profiting more than $1,000. However, Lear said if McGeary was charged with a crime, prosecutors would have to prove his intent by pocketing money from players.

TOUCHDOWN TONY to be charged!. Yet, amazingly, the Utah County DA somehow has no case against Tony. I have to wonder if the haters can now let their kids play ball and get coached without filing frivolous litigation. It is clear Tony McGeary handled every aspect regarding finances for the football program with the utmost integrity and character. Tony still teaches at the school and I’m sure if he had actually stolen money he would have been fired. The case is simple. Parents whine and the school thinks it would be easier to let Tony go rather than deal with whining parents with law degreees who are willing to file frivolous litigation. Dennis, do how well to you know Jerry Sandusky? Why would you bring him into the issue with Tony? Dennis, did you go to Penn State as a young man?

Dennis, Jerry Sandusky was a horrible comparison. Additionally your sarcastic comment regarding the church is quite offensive. Having known Tony for years I can attest to his integrity, honesty, and amazing activity in the church. This "scandal" really comes down to one thing: the district is trying to avoid a lawsuit by disgruntled parents who's boys didn't play. Truly, that is what is going on. I see the large problem within the districts who supposedly claim to have adequately informed coaches of the legality of this issue, yet coaches ALL OVER UTAH are afraid for the jobs right now because the lack of clarity of the issue. It is sad that the districts are only now implementing a summer salary for their coaches, who work hundreds and hundreds of hours for their boys. Why now? Because they had previously allowed the methods that are now an issue.

After reading this I have come to the conclusion that someone's little crybaby did not get to pla and mommie and daddy set out to ruin Tony. $5000 I wonder how much of that was spent on his players over the course of the year. Did he pay camp fees for some who could not afford? Maybe buy a meal or two for the hungry. $5000 scandal in Utah.maybe it is time to return home and complete what Turp started so many years ago

Brian, I just noticed that you have now included a link in the original ABC4 News article (published 2/25; para. 2), which consists of a pdf file detailing the subject 42-page complaint that may be seen here: http://www.abc4.com/media/lib/5/a/c/a/aca9c466-5e22-4772-89f0-36c442662db3/Lone_Peak_HS_Complaint.pdf And while I appreciate you including that link, in the future it would be most helpful if you notified your readers in any CURRENT related article that such supplement(s) have been added to those that have subsequently been moved to the ABC4 archives. Had I not forwarded those articles to another and reread those archived editions, I would have remained unaware of the link you added that detailed the allegations of that complaint. Just a note for future reference. Thanks, again. :)

TOUCHDOWN! Brian. Yet, amazingly, the Utah County DA somehow couldn't seem to figure that out as easily as attorney Carol Lear? I have to wonder if they can now get off their hands long enough to prosecute what appears to be an open and shut case, since it's essentially been handed to them on a silver platter by ABC4. Hopefully, the next thing we'll see is an UNsmiling mugshot of "Touchdown Tony" being charged with that second-degree felony while holding a sign quoting his own words: "I believe I have handled every aspect regarding finances for our program with the utmost integrity and character." But in principle and in fact, how are the actions of the Alpine School District in attempting to cover for Tony McGreary's alleged crime any different than the actions of Penn State in attempting to cover for the now-convicted felon Jerry Sandusky, who was also a "great football coach," don't we all know? I seriously have to wonder about the parents and students of Lone Peak who would go to such lengths in an attempt "to get [our] coach back," especially in a county where one of its "guiding principles" is based on their belief "...in obeying, honoring, and sustaining the law." But I suppose that only applies at church where they gather once a week to compare clothing without so much as a thought for the plight of the poor and needy -- you know, those who could never afford to be ripped off by a popular football coach of such stellar "integrity and character." But in checking further, it appears that: "Intent and motive should not be confused. Motive is what prompts a person to act, or fail to act. Intent refers only to the state of mind with which the act is done or omitted." (Black's, abridged 6th ed., at 560.) Thanks again, Brian, for this informative report. We'll be watching to see what they do with it, now that all eyes are upon them. Maybe they could make a movie some day entitled: "The Longest Yard II," starring one who felt motivated to pocket $5,375.
