Will LDS Church get involved in next California Prop 8 battle?

SALT LAKE CITY (ABC 4 News) - An ex-Utah Mormon and now prominent California gay lawyer is telling ABC 4 two things:

1) Prop 8 is headed back to the ballot.

2) The LDS Church will again play a significant role in trying to defeat it.

Kate Kendell heads the National Center for Lesbian Rights - the lead counsel in the Prop 8 battle.

In a phone interview from San Francisco, Kendell told ABC 4, "There is now a stain on the California Constitution in the form of Prop 8."

Kendell also tells ABC 4 a new measure to get rid of Prop 8 appears headed for 2010 California ballot.

"Make no mistake, we have to get rid of it. It is a very dangerous Amendment in our Constitution," said Kendell.

Kendell feels a California ballot measure is the only way to get rid of the same sex marriage ban, but she's wary of a new effort unveiled Wednesday, a federal lawsuit against Prop 8.

While Kendell feels the U.S. Supreme Court may someday resolve the gay marriage issue, she wonders if now is the best time.

"I do think a federal lawsuit at this point in time is risky and, perhaps, premature," said Kendell.

Kendell, who was raised LDS in Utah, also feels the Church will return to the Prop 8 battle.

"I would be very surprised if the LDS Church did not show up in a very significant way," said Kendell.

And even though a million new ballot signatures must now be collected by the end of 2009, Kendell says, "This is about justice and fairness and every civil rights struggle has had to go through these moments of setback and then you have to be really tested. Do you have the courage of your conviction?"

And when asked if it would get involved in another Prop 8 election, the LDS Church referred us back to its statement Tuesday.

The one re-affirming its belief in marriage between a man and a woman.

ben - we are more technologically advance, but socially we are declining. We don't know more about our ancestors about family relationships. We will be the dispensation that destroys this earth because we are hell bent on destroying the family. Take my words, pull them out in 10 years, and you will go "Wow, I didn't want to believe her."

Shelly.. I REALLY hope we know more than our ancestors, or our society is going backwards. Science is about learning new things. So next time you want to quote science think before speaking. Or better yet, just don't speak till you actually know what you are talking about.

Occam - Studies show the best situation for children is a two parent male/female family. Divorce, single parenting, same-sex parents are all below the optimum. No, procreation is not a requirement for a marriage license. The license was beneficial to society to protect offspring from those unions. What part of "marriage has been the bedrock of society and between a man and woman since the beginning of time" do you not understand? Somehow, we know more than our ancestors?

Shelly, I didn't realize that the ability to procreate was a requirement for a marriage license...actually I don't think it is. Now that you've dragged us into this issue.....why don't you share your views on gay couples adopting. And while you're at it please explain why *you* need to be concerned about the 'maladaptive' nature of homosexual unions and whether or not they meet *your* standards for obtaining a marriage license. Inquiring minds want to know....lay it on us....I'm certain you can provide a *scientific* explanation for your unwarranted concern with the private sexual behavior of consenting adults. Please....you have the floor...I won't say another word.

Just for Occam - I'll post it again: "Religion has nothing to do with my decision, science does. Nature discriminated against gays first. The behavior is maladaptive, and does not qualify for a marriage license. Please take your rhetoric and name calling and be civil with your dribble."

Shelly, until you can come over to my house and bring God with you I have to refute his existence and consequently your attempts to use Him as a valid reference. Science rules baby! And as regards twisting facts....I used to *personally* know active LDS living in the Salt Lake Valley who practiced polygamy....not more than twenty years ago....fact baby! Occam don't lie! I want some wives just like the wives that married dear old dad....hum along with me...

Occam - I love the intellectuals who get on here and twist facts. 1. LDS have not practiced polygamy for over 100 years. God has sanctioned polygamy throughout time. He hasn't done so recently. 2. LDS hold their noses around FLDS. They have perverted the practice. It is nothing like the 1800 polygamy. 3. LDS will probably do what they did when abortion became legal. Fight like hell against it, but uphold the laws of the land when it happens. My personal opinion is the door has been swung open, there is no holding back the gays and their perversion. A piece of paper won't make a difference anyhow. In fact, I say let them get married, only the gays and the Mormons believe in it anyhow anymore! LOL
