Utah Supreme Court reverses Warren Jeffs conviction

SALT LAKE CITY (ABC 4 News) - The Utah Supreme Court reversed the conviction of polygamist leader Warren Jeffs and ordered a new trial on Tuesday.

The Court's ruling to reverse the conviction centered around jury instructions given during the 2007 trial. The Court ruled that the jury was instructed to rule on Jeffs' liability and lack of consent by Elissa Wall, the child bride married to her cousin by Jeffs. The ruling also reasoned that the jury's instructions regarding Jeff's "Intention" to aid in the rape of Wall was erroneous.

In a unanimous decision, the Court ruled that:

"Because we hold that the trial court’s instructions to the jury regarding lack of consent were in error, we reverse Jeffs’ two convictions of rape as an accomplice and remand for a new trial."


Jeffs was convicted in 2007 on two counts of rape as an accomplice for his role in the 2001 arranged marriage of Elissa Wall, who was 14 at the time she was married to her 19-year-old cousin Allen Steed. The marriage was arranged by Warren Jeffs, who was the leader of the Fundamental Church of Jesus Christ of Latter-day Saints at the time.

After leaving the FLDS church, Wall's case was turned over to prosecutors and Jeffs went into hiding. He was arrested in Nevada in August of 2006 during a traffic stop on Interstate 15.

In their ruling, the Utah Supreme Court also addressed Elissa Wall, saying,

"We regret the effect our opinion today may have on the victim of the underlying crime, to whom we do not wish to cause additional pain. However, we must ensure that the laws are applied evenly and appropriately, in this case as in every case, in order to protect the constitutional principles on which our legal system is based. We must guarantee justice, not just for this defendant, but for all who may be accused of a crime and subjected to the State’s power to deprive them of life, liberty, or property hereafter."


Jeffs was also facing extradition to Texas, where he faces charges similar to the case in his Utah conviction, but based on the Court's Tuesday ruling, the extradition hearing scheduled for 1:30 p.m. was canceled. A court spokesperson said the extradition paperwork that was filed by the state of Texas is no longer applicable and a new hearing would not be scheduled.

For those of you that are just about to post on her slamming Mormons or posting some half educated theory, read this before you do. This is not a petition to make you feel better, this is peoples lives that everyone is so casually discussing. I am in no way about to fight for that dirtbag Warren Jeffs or any of the polygamists that are practicing modern day slavery and condoned rape of minor girls, but I am going to say that instead of pointing freaking fingers, do something. These children are innocent in this as they only know what their corrupt, pedophile, and abusive fathers tell them. I am an Active Duty Military Service Member and one of my proud brothers and sisters in arms is a former FLDS Member. I met this young hero just as he entered the military and even though I am his superior, I will ALWAYS look up to this young man. After leaving home at age 16, he was homeless until 18, when he did not require parental consent to join the military. Those 18 months of hell, led to his enlistment and the start of his new battle. I have known my friend for two years now, and there is not a day that passes that he is not fighting to get his brothers, sisters, and mother away from the life they are trapped in. Family is all that matters to this young man. Even though he is free, his people are not and no one will lift a finger!!!! Polygamy will always be present in today's society.....BUT.....SLAVERY, RAPE, INCEST, IMPRISONMENT, KIDNAPPING, and all others type of hell DOES NOT need to happen. Screw the State of Utah, AMERICA CAN FIX THIS!!!!! WE can fix this!! Jeremy and Sharla Johnson of St. George Utah open their home to these young exile FLDS members. Now I know we cannot all help to that extent, but you can do this: instead of surfing internet discussion boards, forums, and blogs to complain or pretend like you care, call your Member of Congress. One voice will not solve a problem, but many open ears to that voice will!! They need you.....

Utah Supreme Court twisted the meaning of the word "Actor" to apply ONLY to Steed, not Jeffs to agree with the defendent. They used the example of a parent suggesting a pregnant child get married.... . "a parent who encourages his pregnant minor daughter to marry the adult father of her unborn baby would satisfy the requirements of that subsection, thereby rendering any further intercourse between the couple nonconsensual and the parent guilty of a first degree felony as an accomplice to rape." However, Warren Jeffs did not "encourages", he COMMANDED with threats of total solitary from family, friends and all. The Supreme Court is WRONG! POLYGAMY is LIVE and WELL in Utah as supported by the law, business and politicans.

why, of course it's still condoned. even though they "claim" otherwise--it doesn't take a rocket scientist to figure out why it's so hard for them to come down on them--- because IT'S STILL IN THE MORMON DOCTRINE. the federal govt forced to them to acquiesce, and while they claim they no longer practice it and "it's in the past"--rofl, anyone with a clue knows better- it's still in there. and mark sh1tloaf is a republican and no doubt mormon himself--no big suprise there!

According to the KSL.com July 14, 2009, utah's polygamist population is about 37,000. Mark Shurtleff refuses to investigate and prosecute polygamists within the state of Utah. Young men are discarded since they are competition for the older perverts, and young girls are tweeny brides subject to rape, sexual abuse and incest. But Mark Shurtleff doesn't want to be “confrontational”. Shurtleff just wants to “build bridges” with criminals. In the KSL 2009 interview with Ben Winslow Shurtleff stated “We will still look”. Yeah, look the other way! Not one LDS church authority condemns Joseph Smith for having a reported 51 wives, some who were young teen girls. Today, in the monthly “Fast and Testimony” meetings, each speaker at either the beginning or end of the testimony drum out: “I know this is the true church, and I know Joseph Smith is the true prophet”. This is the same person with the 50+- wives. Polygamy is still condoned in Utah!

just goes to show you, the dumb mormons are still in charge in utah. and the flds are doing exactly what smith and good 'ol Breed'em Young taught in the beginning. The only reason they stopped is because they were forced to by the federal govt. And it's still in the mormon doctrine. rofl. wait until texas gets his butt. he might as well shoot himself in the head now and get it over with.

The issue in this case isn't about polygamy. It's that a 14-year-old girl was forced to marry and have sex with a 19-year-old man. Steed was convicted of raping Walls. Jeffs was convicted as an accomplice because he commanded (as the incarnation of God in the FLDS church) that Walls obey his order to marry Steed and bear Steed's children. I've nothing against polygamy, or the LDS church. The FLDS, however, is a cult of pedophiles.
