Reported by: Kelli O'Hara
American Fork, Utah (ABC 4 News)- When Jessica Wilkerson let her dog, Daisy, go out and play Sunday afternoon she thought the dog would be gone for just a few minutes. But what she didn't know was it would be the last time the pug would play by the park.

"I was just getting out of the shower and my stepfather started yelling my name, I ran out looking for my dog and there was a crowd around her with a cop," Jessica told ABC4 news on Tuesday, just two days after her dog was killed.

"They told me Daisy was dead," Jessica said while choking up.

Police believe the pug was run over by her neighbor, Patrick Durrant.

Durrant was apparently angry, investigators tell ABC4, after Daisy had pooped on his lawn, "He backed out of his driveway, saw the dog and crossed over into the other lane of traffic, ran her over then backed up and ran her over again," Jessica said.

Durrant was cited with two counts: animal cruelty and improper lane travel. It's up the City Attorney's Office to charge the 36-year-old driver but the Humane Society says that's not good enough.

"The courts need to make an example out of him and use the statute, charge him with a felony," Carl Arky with the Humane Society told ABC4 news.

Arky along with the organization is calling upon the County to charge Durrant with a felony because driving over a dog twice constitutes "torture" the Spokesperson continued.

As for Jessica, she doesn't care about the charges, she just is left to wonder about one thing, "I hope she didn't feel any pain."

So they'll throw the book at this guy. On the other hand, if the owner did not respond to requests to monitor her dog's intrusions, reprocussions were inevidable. Anyone disgusted with the perp ever step up to another dog owner and demand they take responsibility. It is highly probable that there is an unpublished history here. As usual there is probably another side. Having said all that, killing the dog was too far to go.

Another tragedy that could have been prevented if we had stricter gun control laws.

I think there's two losers in this situation. One being the dog owner who lost her pet to initiating irresponsible behavoir due to irresponsible habits of what should be responsibility to ones pet like the monitoring and clean up there after of ones own animal or pet with a sense of respect for others and their property. And of course the guy in this story who after being charged with all of this will hopefully realize that anger especially over little things like this should not be acted upon in the worst manner possible but thought out and be resolved through something much less violent and much more sensible like a reasonably thought out beforehand conversation or attempt to communicate about the problem through a means where the end result is a much more favorable outcome for both parties involved in something like this and not the disturbing aftermath of an incident that easily could have been avoided all with a little knowledge of what doing the right thing really is.

This is just wrong on so many levels and just makes me sick to my stomach. Eventhough I hold the owner accountable for not protecting her dog and just letting it run loose like so many ignorant people seem to do, it doesn't even come close to the gross cruelty of the individual that outright murdered the animal. This sick person should be made an example of and charged to the maximum extent of the law. This act could be a precursor to other violent crimes.

My bet is they law will not charge him with a felony although I think he should be. Why not put this guy's picture on the news and papers make him look like the jerk that he is.

Let's agree to this: A dog owner shouldn't just let their dog/dogs run out of the house free. Dogs are dogs, and THEY DON'T KNOW BETTER! WHEN THEY HAVE TO POOP, THEY POOP! WE HUMANS, as the owner of our dogs have a responsibility to our fellow neighbors. My dogs have had 'urgent accidents' on others lawns, and after putting my 2x Black Labs inside my house, I promptly cleaned-up after them. This 'neighbor' should be held accountable, based on the 'facts' of this story, having INTENTIONALLY killed his neighbor's dog. I can understand his frustration. He could have lured the dog into his house with a nice treat, and told his neighbor, "You're not getting him back, until you look after your own puppy!"

ok she was probably wrong for just letting her dog run loose and the pooping on the guys lawn could have been avoided. However, that alone does NOT give him the right to intentionally murder, yes its murder, that animal. I think they should charge him with a felony but this incident should give all awareness to animal owners that just because we love our pets and consider them family does not mean others do too and just as we watch over and protect our innocent children, so should we protect and watch over our innocent animals.

honestly this is sick... no amount of dog poop on ones yard is worth killing the animal and breaking laws. Yes the owner should have a fenced area, or been with the dog. The "man" could have easily knocked on her door, called animal control, or freaking just picked up the poop. Her fault in the matter was letting her dog out lose. It was only his fault that he is so angry to kill someones pet. That is just wrong

I agree with the other posters here. I bet there has been quite the history of this dog pooping on the guy's lawn.
