Insurance co. asks: Do Powell siblings get money?

SEATTLE (AP) - A life insurance company is asking a judge to decide whether any of Josh Powell's relatives are entitled to collect on a $1.5 million policy after he killed himself and his two sons in a house fire last month.

In a complaint filed in U.S. District Court in Tacoma, New York Life says it received inquiries from Powell's sister and brother about how to make a claim on the policy. The complaint does not say that the siblings have actually filed any such claims.

Lawyers for the company say they want to turn over to the court's control the proceeds payable under life insurance policies covering Josh and his wife Susan Powell, who disappeared from their Utah home in 2009, and let the judge decide who gets the money.

What happens happens. The Family should not benefit from the children's death and I'm sure they dont want to. Its sad that this situation has turned into a controversy on money. The boys and there mother should not be remembered by how much money there family gets back. Im sure that if you died, and there was a controversy over how much money your family should get back. You would not want to be remembered that way. Its a sad situation that needs to be taken care of so these boys and their mom can be remembered for their lives. Not for how they were taken.

I'm sorry - but what really bothers me is that Alina, Mike and John all received emails and phone calls from Josh telling them how to close out his finances hours before he chopped up his children and set them on fire. They did nothing to protect the boys. And Alina and John lived less than 15 minutes away. Alina called 9-1-1 to say she was afraid to go over there because she was afraid of what she would see? That sure sounds as if she knew what he was about to do, and in fact did do. Why should they profit from the boys death? This just really bothers me. Doesn't it bother you?
