No charges for brothers in sister's BB gun death

LEWISTON, Utah (AP) - Prosecutors say no criminal charges will be filed against two young boys from Lewiston who shot and killed their 4-year-old sister in August with a BB gun.

Cache County Attorney James Swink tells the Logan Herald Journal the boys are receiving counseling for what he calls a tragic accident. He said prosecutors screened the case for possible charges but did not find enough evidence to proceed.

Authorities say Karely Arzeta-Reyes suffered a fatal head injury after the shooting Aug. 17.

Sheriff's deputies say the girl's 11-year-old and 9-year-old brothers were pumping their BB guns and shooting her with air.

A BB that was still in the 9-year-old boy's gun discharged and shot her in the head.

The girl was taken to two different hospitals but died a day later.
