MacNeill attorneys file for dismissal of murder case

PROVO, Utah (ABC 4 News) - Attorneys for Martin MacNeill have filed a motion to dismiss the homicide charges against him for prosecutorial misconduct.

MacNeill is the doctor accused of murdering his wife Michelle back in 2007.

His attorneys have asked for all information on MacNeill's suspected crime, but prosecutors say the state isn't obligated to provide it. According to court documents, MacNeill's attorneys claim some evidence suggests one of the couple's son's might have been prone to violent tendencies.

MacNeill is set to stand trial beginning March 5th.
