OGDEN, Utah (ABC 4 News) - The man accused of killing one police officer and wounding six others appeared in court on Monday.
Matthew David Stewart appeared for a status conference in which a judge scheduled a preliminary hearing for October 31.
The three-day hearing will determine whether there's enough evidence against Stewart to go to trial.
Stewart faces Aggravated Murder charges over the death of Ogden Police officer Jared Francom, who was killed in
the January 4 shootout involving Stewart and members of a drug task force.
Prosecutors are
seeking the death penalty against Stewart.
The task force was trying to serve a drug warrant at Stewart's home when prosecutors say the defendant opened fire on the officers.
Stewart was also injured in the melee, and spent several days recuperating in a hospital.
