OGDEN, Utah (ABC 4 News) - Matthew David Stewart, the suspect in a shootout with police officers has been released from a hospital and booked into the Weber County Jail.
Earlier Monday, prosecutors said the case in the January 4th shootout with police officers had been halted until Stewart could be released from the hospital.
Weber County prosecutor Dee Smith told ABC 4 News that Matthew David Stewart remained hospitalized in an undisclosed location recovering from injuries he sustained in the shootout with officers from the Weber-Morgan drug task force.
Agent Jared Francom, who was also an officer for the Ogden City Police department was
killed in the melee involving the serving of a drug warrant at Stewart's home.
Five other officers were injured in the shootout.
All of them have been released from Ogden's McKay-Dee hospital since the shootout.
Stewart has
been charged in the death of Francom and the attempted murder of the other officers involved in the shootout.
Smith said Stewart was due to appear in court for arraignment, which could not happen until was released from the hospital.
The Weber County Sheriff's department said Stewart was booked on one count of criminal homicide aggravated murder (a capital offense with possession of a dangerous weapon enhancement); Seven counts of attempted aggravated murder (a 1st degree felony with possession of a dangerous weapon enhancement); and One count Production of a controlled substance in a drug free zone (a 2nd degree felony.)
Stewart was being held without bail.
