SANDY, Utah (ABC 4 News) – ABC 4 is learning new information about the case of a toddler who shot and killed himself in Sandy, including his identity and whether or not charges will be filed.

Wednesday morning Sandy police said the toddler was 2 year old Ethan Hearty from Denver.

His death put an entire Sandy neighborhood in shock.

“It gave me chills, it made me think where are my kids at?” said one neighbor.

“It’s sad. I feel really bad for the parents,” said another.

Hearty’s family was visiting Utah from Denver. While his grandfather and siblings were in another room, Ethan found a handgun in the master bedroom, and accidentally shot himself. The boy was airlifted to Primary Children’s Medical Center, but later died.

Sandy police looking into the case do not believe a crime occurred. However, they are making a report to the District Attorney.

“There’s no charges we’re specifically looking at, it’s just the process that these cases are investigated,” said Sgt. Jon Arnold, Sandy Police Dept.

Police told ABC 4’s Brian Carlson the District Attorney will have the final say. So far, they think it’s highly unlikely the family will face legal consequences.

“What they’re going through right now is far worse than anything legally that could be done to them,” said Arnold.

I never said that they aren't good people; I'm sure they are very nice. Unfortunately, the grandfather is an irresponsible gun owner. Irresponsible and reckless to the point that someone was killed. I feel bad for the family and the young boy. I would be devastated if I were as careless and irresponsible as Grandpa and one of my family members was killed by one of my firearms.

At no time have I claimed to be perfect so leave the personal attacks out of this. My comment is made from the perspective of a responsible gun owner. Leaving a loaded firearm within reach of such a young child is egregious and unacceptable. The child paid for the granfather's mistake with his life - a harsh penalty for the boy to pay.

I have to say you are so insensitive. This was such a huge accident and the poor man is going to feel so bad and blame himself forever! this poor family is going through so much loss right now and your put a jerk of a comment like that! These people are great people and for how much they have gone through they don't need rude people like you and not your opinion. This man probably never has children around and didn't even think to remember. Truly a sad accident. Don't be to so harsh to judge. I'm pretty sure you are not perfect at all just like the rest of us.

In many states, leaving a handgun within reach of a minor is a crime. The grandfather clearly wasn't thinking of his grandson when he decided to leave the handgun loaded and within reach of the poor child. How hard would it have been to unload the handgun? How about a trigger lock? Why not put it up out of reach of the child? Grandpa should face charges, up to and including negligent homicide, for this one.
